Acceptable Use Policy

1. About This Policy

Oculamor is built to help families stay safe on the road. This Acceptable Use Policy explains how we expect the platform to be used so that everyone has a positive, safe experience.

This policy forms part of our Terms of Service. Most of what's here is common sense — we're simply being transparent about the rules so you know where you stand.

Oculamor Ltd is registered in England and Wales (Company No. 17011848) and with the ICO (Registration No. ZC090570).

2. Permitted Use

The Service is designed for lawful vehicle monitoring by authorised persons. Permitted uses include:

  • Monitoring the location and status of vehicles you own or are authorised to track
  • Receiving safety alerts for your own vehicles
  • Viewing driving behaviour feedback for your own driving
  • Sharing vehicle location with family members who have been informed and have consented
  • Managing a fleet of vehicles where all drivers have been informed in writing (requires a Fleet subscription and Data Processing Agreement)

3. Prohibited Use

3.1 Consent is Essential

Oculamor is a family safety tool. Every person whose vehicle is monitored must know about and agree to the tracking. This isn't just our policy — it's UK law.

Tracking someone without their knowledge or consent may constitute a criminal offence under the Protection from Harassment Act 1997, the Serious Crime Act 2015, or the Stalking Protection Act 2019.

If we become aware of misuse, we will suspend the account and cooperate with law enforcement where appropriate.

3.2 Other Things to Avoid

To keep the platform safe and fair for everyone, please do not:

  • Install a device in a vehicle you do not own without the registered keeper's consent
  • Track a vehicle driven by someone who hasn't been informed and agreed
  • Use the Service to locate someone against their will
  • Track employees without providing them with a written tracking policy first

3.3 Platform Integrity

Please also do not:

  • Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our systems
  • Reverse engineer, decompile, or disassemble the Service or any OBD-II device firmware
  • Use the Service to transmit malware, viruses, or any harmful code
  • Resell, redistribute, or commercially exploit the Service without written authorisation
  • Create multiple accounts to circumvent usage limits, bans, or restrictions
  • Provide false or misleading information during registration or driver consent flows
  • Tamper with, modify, or attempt to bypass safety features of the OBD-II device

4. Driver Consent Requirements

4.1 Your Obligations

When you install an OBD-II device in a vehicle, you are responsible for ensuring that:

  1. Every person who regularly drives that vehicle is informed that the device is installed and what data it collects
  2. Each driver understands that their location, speed, and driving behaviour will be monitored and recorded
  3. Each driver consents to the monitoring
  4. Driver consent is recorded via the Oculamor platform's consent flow
  5. Consent is kept current — if the regular driver changes, you must update the consent record

4.2 When Consent Cannot Be Obtained

If a driver does not consent to being monitored, you must not track that vehicle while they are driving it. The Service includes the ability to pause tracking on a per-device basis.

4.3 Withdrawal of Consent

Any tracked driver can withdraw their consent at any time by contacting the account holder directly, contacting Oculamor at [email protected], or by reporting through the abuse reporting mechanism described below.

4.4 Drivers Reaching Adulthood

If a monitored driver turns 18 during the course of monitoring, the account holder is responsible for obtaining the driver's own informed consent to continued monitoring on or before that date. Monitoring without fresh consent from that date onwards is not permitted and may constitute a breach of this policy and of UK law.

5. Safety & Support

5.1 Concerned About Unwanted Tracking?

If you think someone may be using Oculamor to track you without your knowledge, we're here to help. Please get in touch:

We will:

  • Acknowledge your report within 24 hours
  • Investigate and take appropriate action within 72 hours
  • If warranted, immediately disable tracking on the identified device
  • Preserve relevant data for law enforcement
  • Not disclose to the account holder that you have made a report (unless required by law)

5.2 Other Support Resources

We take the safety of all road users seriously. If tracking is being used inappropriately, we will act quickly to protect those affected and work with the relevant authorities.

5.3 Safe Exit

If a monitored driver contacts us and credibly reports that the Service is being used against them (including in contexts of domestic abuse, coercive control, stalking, or harassment), we may, at our sole discretion and without notice to the account holder:

  • immediately stop publishing the driver's location and driving data to the account holder's view;
  • preserve historical data securely for a reasonable period in case it is required by police or another competent authority;
  • provide the reporting driver with an independent, secure copy of their own personal data;
  • suspend the device, the account, or both, pending investigation;
  • cooperate with police, the ICO, and support charities as appropriate;
  • refrain from disclosing the existence or content of the report to the account holder, unless required by law.

This clause exists to protect people from harm. It supplements — and does not replace — the rights set out in the Privacy Policy or any remedy available under law.

6. Fleet and Business Use

If you use the Service for fleet management or employee vehicle monitoring, you must:

  • Have a Data Processing Agreement with Oculamor (Article 28 UK GDPR)
  • Provide all monitored employees with a written Vehicle Tracking Policy before tracking begins
  • Conduct your own Data Protection Impact Assessment for employee monitoring
  • Have a lawful basis for the monitoring
  • Obtain employee consent for tracking outside of working hours, or have a documented justification

7. What Happens If Something Goes Wrong

We'll always try to resolve issues informally first. If there's a misunderstanding, we'll reach out and help you get things right. For more serious issues, we may need to take further action:

  • Minor issues — We'll get in touch with guidance on how to fix it
  • Repeated issues — We may temporarily pause your account until the issue is resolved
  • Serious misuse — We may close your account and, if legally required, work with the relevant authorities

8. Changes to This Policy

We may update this AUP from time to time. Material changes will be notified via email to registered users and posted on our website. Continued use of the Service after notification constitutes acceptance of the updated AUP.
